The Justice Department has decided not to press charges against Daniel Pantaleo, the officer who placed Eric Garner in a choke hold, resulting in the death of the 43-year-old.

Now, Eric’s youngest daughter, Emerald Garner, is starting a petition to have the officer fired.  The petition begins:

“Hello I am the youngest daughter of Eric Garner, Emerald Garner, please hear my message and continue to stand with my family through this trying time. My sister Erica died before she could see justice for our father, and I refuse to leave this Earth until I see justice for Eric Garner and all others who were murdered at the hands of the murdering police officers who took an oath to protect and serve the communities.”

Later in the petition, Emerald makes a direct call to action for New York City Mayor Bill DeBlasio to fire Pantaleo effective immediately.

The Department of Justice concluded their investigation almost a year ago; however, it was not until days before the fifth anniversary of Eric’s death that they decided not to press charges again Pantaleo.

Following the announcement from the DOJ, Emerald Garner gave a very emotionally charged speech outside of a Brooklyn court house, where she adamantly demanded that Officer Pantaleo be held accountable for his killing of her father.

Emerald Garner told Change.org she wanted to start the petition “to spread the word as much as possible that I will not stand for injustice, and that I will do everything I can to get justice for my father, and justice for all of my family members who have fought for five years to hold the officer who killed my father accountable.”

Since that fateful day for Garner in 2014, Pantaleo has been on a modified assignment without a gun or a badge. He has stated that he wishes to stay with the NYPD despite the death that he caused.
